Restoring Zoning Rights for the Portola Hotel & Spa in Monterey

We represented the owners of the Portola Hotel & Spa with an inverse condemnation and land use / zoning lawsuit related to the City of Monterey’s $60 million conference center renovation and its attempted changes to surrounding land uses (Portola Hotel & Spa v. City of Monterey).

The Hotel, situated immediately adjacent to the historic Fisherman’s Wharf in Monterey, suffered significant construction impacts, including loss of access, removal of building improvements, and overall goodwill as a result of the City’s construction.  The City also passed ordinances which impacted the Hotel’s zoning and proposed to change a pedestrian-themed walkway through the property into an area for public transportation.

With our guidance, the matter was successfully resolved with the Hotel receiving millions of dollars in compensation along with restoring its key property and vested zoning rights.
