Veronica Gray Quoted In OC Register On Potential Impact of AB 465

Nossaman partner Veronica Gray was quoted in the Orange County Register story Will Aggrieved Workers Get Their Day In Court? Governor Brown Must Decide Whether To Sign A Bill To End Mandatory Workplace Arbitration. If signed by Governor Brown, a bill passed by the California Legislature  in August, AB 465, would make California the first state to ban arbitration agreements as a condition of employment and outlaw retaliation against current employees who refuse to sign them. Gray commented that if AB 465 becomes law, companies will be severely restricted in their use of mandatory arbitration agreements. Employers...will have the burden of proving they were not made a condition of employment. She also noted that if companies  argue that a potential employee who refused to sign was not hired for other reasons, That sets the employer up for a retaliation claim – and a very slippery slope.
