We advise clients concerning estate planning and on techniques for reducing or eliminating federal estate and gift taxes and taxes on generational transfers. As necessary, we also advise and/or represent clients in trust, probate, and conservatorship administration proceedings and litigation.
Our work includes preparation of trust agreements, wills, and other documentation necessary to implement estate plans, including probate avoidance trusts, irrevocable trusts and insurance trusts, family limited partnerships, limited liability companies, and similar fractional ownership devices. We advise trustees and executors regarding routine and complex issues in the administration of trusts and estates.
We also represent trustees, executors, and beneficiaries in litigation regarding the rights of beneficiaries under trusts and wills, including litigation regarding trustees' and executors' accounts. Additionally, we advise concerning community property matters, and we prepare community property agreements, premarital agreements and spousal property agreements.
We have developed an expertise in elder care, and we advise and initiate legal proceedings when necessary to protect older individuals from abuse, theft of assets, and fraud. We also advise clients regarding conservatorships and represent them in conservatorship litigation.
