High Court to Rule on Cleanup: Case Could Affect Valley's Whittaker-Bermite Site

Nossaman Partner and Water Law Practice Group Chair, Fred Fudacz, was quoted in the Los Angeles Daily News in an article discussing the ongoing U.S. Supreme Court case, U.S. v. Atlantic Research Corporation. The case could potentially impact water purveyors’ ability to recover costs associated with cleaning up contamination, which is an important issue to several Nossaman clients who hired the firm to submit an amicus curiae brief to the Supreme Court in support of the Eight Circuit Court’s ruling. Those clients include the Association of California Water Agencies, the National Association of Water Companies, the California Water Association, the California State Association of Counties, the Castaic Lake Water Agency, the San Gabriel Basin Water Quality Authority, and the Main San Gabriel Basin Watermaster.

In the article, Mr. Fudacz explains the potential impact of the Supreme Court decision in this case, "a favorable result will help promote cleanups all across the country."
