REPRESENTATIVE WORK

City of El Paso – El Paso Regional Rail Project – Nossaman assisted the City of El Paso, Texas in developing institutional strategies and structuring intergovernmental agreements relating to the development, construction and financing of a $500 million Regional Intermodal Rail Project which would provide for new international border crossings, rail line reroutings for freight railroads (including BNSF and Union Pacific) and new intermodal facilities.

Florida Department of Transportation – Port of Miami Tunnel – Nossaman is key outside legal advisor for the procurement of a public-private partnership to design and construct a bridge and tunnel project linking the Port of Miami facilities on Dodge Island with MacArthur Causeway and the I-395. This was only the second availability payment contract executed in the United States. The project was named the 2007 Project of the Year by the American Road and Transportation Builders Association, both the 2009 Global Deal of the Year and North American PPP Deal of the Year by Project Finance Magazine, as well as the 2009 Americas PPP Deal of the Year by Project Finance International.

Metropolitan Transit Authority of Harris County, Texas – METRO Solutions Phase 2 – Nossaman served as lead outside legal advisor on contracts for the development of four light rail lines (the North Corridor, the Southeast Corridor, the East End and Uptown lines), supply of vehicles, and operations and maintenance, with an estimated cost of $1.46 billion for design, construction, and supply of vehicles. Nossaman assisted with public-private partnership transaction and procurement structure, drafting contract and RFP documents, risk allocation and negotiations.

City of Anaheim / Orange County Transportation Authority – Anaheim Regional Transportation Intermodal Center – Nossaman is special counsel to the City for the financing, development, and operation of a transportation hub and mixed-use activity center on a 16-acre site publicly owned by the Orange County Transportation Authority (OCTA) and the City of Anaheim. 

Alameda Corridor Transportation Authority – Mid-Corridor Project – Nossaman assisted with procurement for a $712 million design-build contract for the critical 10-mile middle section of the Alameda Corridor rail/grade separation project in Los Angeles. The entire $2.4 billion, 20-mile project, linking the Ports of Los Angeles and Long Beach with the national freight rail system opened in 2002, on time and under budget. The project won more than a dozen industry awards, including the 2003 Design-Build Institute of America Project of the Year Award, the 2003 California Transporation Foundation TRANNY Award for Project of the Year and the 2002 American Railway and Engineering Maintenance-of-Way Association Award for Excellence.

City of Reno - Reno Transportation Rail Access Corridor (ReTRAC) Project – Nossaman represented the City of Reno in connection with the planning and development of a $231 million, 2.25-mile depressed rail corridor and grade separation project, the first public design-build project in the State of Nevada. Our services included advice on compliance with FHWA and Nevada Department of Transportation requirements; risk analysis; development of a procurement plan, procurement and contract documents; advising the City concerning utility relocation and due diligence matters relevant to the design-build procurement; assisting in the contractor selection process; and in contract administration.
