We have assisted clients with a range of legal and transactional services in the development of tunnels and bridges.
REPRESENTATIVE WORK
Florida Department of Transportation – Port of Miami Tunnel – Nossaman is key outside legal advisor for the procurement of a public-private partnership to design and construct a bridge and tunnel project linking the Port of Miami facilities with MacArthur Causeway and the I-395. This was only the second availability payment contract executed in the United States. The project was named the 2007 Project of the Year by the American Road and Transportation Builders Association, both the 2009 Global Deal of the Year and North American PPP Deal of the Year by Project Finance Magazine, as well as the 2009 Americas PPP Deal of the Year by Project Finance International.
Washington State Department of Transportation – Tacoma Narrows Bridge – Nossaman negotiated a comprehensive development agreement for development, finance, operation, and maintenance of a new toll bridge span over the South Puget Sound. This is the first major suspension bridge in the United States in thirty years and opened to traffic on July 16, 2007.
North Carolina Turnpike Authority - Mid-Currituck Bridge – Nossaman is serving as legal advisor on the procurement for a new nine-mile tolled bridge facility over Currituck Sound to the Outer Banks. The project will be developed as a public-private partnership under a pre-development agreement executed in April 2009.
Washington State Department of Transportation and Oregon Department of Transportation – Columbia River Crossing Project – Nossaman has been retained to advise on institutional and legal frameworks for developing the Columbia River Crossing. Our work includes analysis of new agency formation, bi-state agreements and interstate compacts, and financing and contracting structures.
Minnesota Department of Transportation – Design-Build Program; Interstate 494 and I-35W St. Anthony Falls Bridge Design-Build Projects – Nossaman is advising with regard to development of a design-build program, including:
- Analysis of enabling legislation;
- Assisting Mn/DOT in the development of design-build policies;
- Development of design-build RFP documents;
- Adapting existing standards for design-build; and
- Analysis of issues associated with federal funding, including review of requirements contained in the design-build rule and development of proposal forms to address those requirements.
Nossaman is also developing procurement and design-build contract documents for the I-494 Design-Build project and the I-35W St. Anthony Falls Bridge Project under this program. The project won the "2005 Roadway Project of the Year" award from Roads & Bridges magazine.
Louisiana Department of Transportation and Development – John James Audubon Bridge –Nossaman assisted the Louisiana TIMED Managers (LTM) and the Louisiana Department of Transportation and Development in the design-build procurement of a cable-stayed Mississippi River crossing. Services included legislative analysis, procurement strategy and risk analysis, drafting procurement and contract documents, and assisting in evaluation of SOQs and proposals.
Atlandia Design & Furnishings – Atlantic City/Brigantine Connector – Nossaman served as special design-build counsel for a cut-and-cover tunnel/highway project in Atlantic City, New Jersey. The connector, completed ahead of schedule and under budget, received the 2001 Award of Merit from New York Construction News and the Heavy Construction Project of the Year Award in 2000.
Nevada Department of Transportation - I-15 North, US 95 to Craig Road Design-Build Project – Nossaman assisted with the procurement of a design-build contract for the widening of 5 1/2 miles of I-15. Nossaman's role included a legislative compliance review, review and drafting of procurement and contract documents, analysis regarding modifications required to Silver Book provisions for design-build projects, and assisting the Department in determining appropriate insurance coverages for the project.
