REPRESENTATIVE WORK
Veolia Water North America Operating Services, Inc. – Nossaman advises on industrial projects and municipal privatizations of water and wastewater treatment facilities, including maintenance agreements, design-build agreements, DBOM agreements, and agreements that include financing elements. Our work has included preparing and drafting the legal portions of U.S. Filter Operating Services' request for proposal submissions, structuring all legal aspects of the transactions, drafting and negotiating the major project agreements, and assisting with project finance structuring.
Montgomery Watson – Nossaman advises on procurement and contracting matters in California, including issues regarding procurement authority of agencies with which MWH works, preparation of proposals and contract negotiation.
Poseidon Resources Corporation – Nossaman represented Poseidon Resources Corporation with respect to the land use and permit approvals for a Seawater Desalination Facility. We reviewed and provided detailed permitting strategies and guidance for the 18 local, state, and regional permits that Poseidon needs to construct the $250 million facility, which will be the largest of its type in the Western United States. We represented Poseidon in all negotiations with city staff, planning commission and city council hearings in the cities of Huntington Beach and Costa Mesa, California.
