Josh Burke focuses his practice on infrastructure, procurement, finance, construction and real estate transactions law.  He has represented clients in a wide variety of transactional matters and has drafted agreements related to the development of various commercial and government projects.  Mr. Burke plays key roles in the development of procurement and contract documents and regularly performs research on various legal matters.

During law school, Mr. Burke served as a judicial intern for the Honorable Debra H. Lehrmann of the Supreme Court of Texas and represented children in the Texas foster care system as a student attorney for the Children’s Rights Clinic.  Prior to practicing law he taught history and coached at Crockett High School in Austin, Texas.

Representative Work

  • Texas Department of Transportation – Oak Hill Parkway Project. Key member of the legal team advising on the procurement of a proposed $500 million design-build project to reduce congestion and improve mobility in the Southwest Austin area. The Oak Hill Parkway Project will include the design and construction of approximately 7 miles of non-tolled improvements along US 290 from Circle Drive to Loop 1 (Mopac) and along SH 71 from US 290 to Silvermine Drive. The project will also include the reconstruction of the US 290 and SH 71 interchange. TxDOT issued an RFQ in October 2018 and shortlisted four teams in December 2018. Mr. Burke’s duties involve assisting with drafting procurement documents, including contract documents, as well as advising TxDOT in connection with meetings with proposers, responding to proposer questions and negotiating inter agency agreements with stakeholders. Conditional contract award is anticipated in early 2020.
  • North Tarrant Express Segment 3C.  Member of the legal team advising on the negotiation and closing of a change order to add a $750 million expansion segment to the Facility Agreement for NTE Segments 3A & 3B. Mr. Burke currently assists with preparations for commercial and financial close and the drafting and review of ancillary closing documents. Commercial and financial close of the change order are expected in the spring of 2019.
  • Texas Department of Transportation – I-35 NEX Project. Member of the legal team advising on the procurement of a proposed $1.8 billion design-build-maintain project to manage vehicle congestion, promote efficient use of existing transportation facilities and improve regional mobility along I-35 from I-410 South to FM 1103. The I-35 NEX Project consists of 15.4 miles of non-tolled improvements that will include the construction of elevated mainlanes - two general purpose lanes and one HOV lane in each direction - between I-410 South and FM 3009 and improvements between FM 3009 and FM 1103 to provide an additional general purpose lane and an additional HOV lane in each direction along with other operational improvements. Also, additional direct connectors will be constructed at the I-410 South interchange, the I-410 North interchange and the Loop 1604 interchange. Mr. Burke assisted with drafting requests for information from industry. Conditional contract award is anticipated in the spring of 2020.
