Jaya Velamakanni is a member of the Infrastructure Practice Group.  She assists public agencies with a variety of construction, procurement and contracting matters.  She conducts legal research and drafts documents relating to design-build, public-private partnerships (P3s) and design-build-operate-maintain agreements.

Representative Work

Indiana Finance Authority – Ohio River Bridges Project, East End Crossing. Member of the team advising on the P3 procurement to design, build, finance, operate and maintain the East end Crossing that will connect Kentucky to Indiana.  The East End Crossing will be procured and developed as an availability payment concession.  The $800 million (capital cost) project includes: a new six lane East End Bridge that crosses the Ohio River; the East End Kentucky Approach to the Bridge that will serve as an extensions of the I-265 (Gene Snyder Freeway) and the East End Indiana Approach that will serve as an extension of IN 265 (Lee Hamilton Highway). Services include assisting IFA with structuring the procurement, drafting and finalizing the RFP documents, developing the evaluation process and negotiating the public-private agreement.  Commercial close was achieved on December 27, 2012 and financial close occurred on March 28, 2013.

Maryland Transit Administration.  Member of the team serving as lead outside legal advisor for MTA's P3 program. The team is currently assisting in (1) the evaluation and potential development of P3 approaches to major public transit initiatives, including the proposed Red Line, the Purple Line, and the Corridor Cities Transitway (CCT) and (2) the development of policies, regulations, procedures, and/or legislation required to implement public transit and other transportation initiatives as P3s in the State of Maryland.

Metropolitan Washington Airports Authority – Dulles Rail Corridor Metrorail Phase 2.  Member of the team representing the Authority in the procurement of the design and construction of Phase 2 of the Dulles Corridor Metrorail Project.  The anticipated project cost is $2.7 billion, and will include the design and construction of 6 stations starting at Wiehle Avenue in Fairfax County and ending in Loudoun County.

North Carolina Department of Transportation – I-77 HOT Lanes Project. Member of the team assisting the Department with the structuring and administration of a procurement of a toll concession P3 for $600 million high occupancy toll lanes along the I-77 corridor near Charlotte, North Carolina.  Services include reviewing the procurement documents and researching applicable laws affecting the procurement.

New York State Thruway Authority and New York State Department of Transportation – Tappan Zee Hudson River Crossing Project. Member of the Nossaman team advising NYSTA and NYSDOT on the procurement and development of contract documents for the development of a new bridge and related facilities across the Hudson River near Tarrytown, NY, and the demolition of the existing 3-mile bridge. Services include drafting procurement and contract documents, analysis of legal issues affecting the project, assessment of risk and development of matrix regarding allocation of risks, participation in one-on-one meetings with proposers, and drafting addenda and other communications with proposers.

Prior Experience

Prior to joining Nossaman, Ms. Velamakanni was an intern for the Office of the Attorney General of New York, a legal intern with the project finance firm Cape Wind Associates, and a foreign exchange analyst for The Royal Bank of Scotland in Stamford, CT.
