Patricia de la Peña assists public and private infrastructure project owners in developing procurement documents, drafting and negotiating contract documents, contract administration, and advising clients with respect to public-private partnership insurance issues.

Texas Department of Transportation – North Tarrant Express Project. Advising the Department regarding the procurement for the North Tarrant Express Project in Forth Worth, a public-private partnership project. The project is a 52-year term project that includes reconstruction of existing non-tolled lanes, addition of new managed lanes, related frontage roads, installation of tolling infrastructure, as well as operations and maintenance. Drafted the request for proposals, reviewed technical exhibits, and was one of the attorneys primarily responsible for drafting the contract documents and preparing responses to written questions from proposers. Served in an advisory role during the proposal evaluation process and participated in negotiations with the selected proposer to finalize the contract documents. The $2.02 billion project was named Infrastructure Journal's 2009 Global Transport Deal of the Year. Ms. de la Peña is currently advising the Department regarding contract administration issues in connection with the project.
Texas Department of Transportation – IH 635 Project. Advising the Department regarding the IH 635 Project in Dallas. Served in an advisory role during the proposal evaluation process and assisted in finalizing contract documents for commercial close of the project. Ms. de la Peña is currently assisting the Department with contract administration issues.
Texas Department of Transportation – SH 161 Toll Road Project. Advising the Department regarding the procurement for the SH 161 Toll Road Project in Dallas. Drafted the request for qualifications and served in an advisory role in connection with the evaluation of the submittals. Ten proposals were received and four teams were shortlisted.
Metropolitan Transit Authority of Harris County. Member of the team advising the Metropolitan Transit Authority of Harris County in implementation of Phase 2 of its METRO Solutions Program, including providing advice regarding laws applicable to METRO's program, advising METRO regarding insurance issues, and working on procurement and contract documents for design, construction, operations and maintenance of high capacity transit and related facilities in five travel corridors in the METRO service area.
Metro Gold Line Construction Authority. Member of the team working on procurement and design-build-finance contract documents for the public agency responsible for developing the Gold Line light rail system, for the Iconic Freeway Structure and Foothill Extension Phase 2 Alignment Contract.
