REPRESENTATIVE WORK
Florida Department of Transportation – I-595 Corridor Improvements Project – Nossaman has been the key outside legal advisor on the procurement for redevelopment of a section of the I-595 corridor in the Ft. Lauderdale area. This $1.8 billion deal is the first in the U.S. transportation sector to use an availability payment compensation structure. Our work has included comprehensive legal and procurement assistance, including drafting procurement and contract documents, facilitating the financing structure, and leading contract negotiations. The American Road and Transportation Builders' Association named the project its 2009 Project of the Year and Project Finance named it 2009 North American Transport Deal of the Year.
Texas Department of Transportation - LBJ Express Project (I-635) – Nossaman served as key outside legal advisor on the procurement of a public-private partnership toll concession to design, build, finance, and operate an express lanes project in Dallas.
Texas Department of Transportation - DFW Connector – Nossaman serves as key outside legal advisor on the procurement of a design-build contract to develop a 16.2-mile managed lanes project with five interchanges across seven highways in the Dallas / Fort Worth area at an estimated project cost of $762 million.
Riverside County Transportation Commission – PPP Program – Nossaman is acting as the Commission's strategic advisor to assist in the development and implementation of a potential public-private partnership program for several major project initiatives, including the SR-91 and I-15 Managed Lanes Projects.
Orange County Transportation Authority – State Route 22 Reconstruction and Widening – Nossaman served as special counsel for the development of approximately $300 million in improvements to State Route 22 freeway. We advised on all legal aspects of the procurement process, including:
- Procurement method recommendations;
- Procurement and contract document preparation;
- Industry review process administration;
- Contract administration;
- Change orders;
- Construction claims;
- Dispute resolution; and
- Insurance issues.
Orange County Transportation Authority – State Route 91 – Nossaman was involved in the negotiation and drafting of the $50 million design-build contract for the Route 91 High Occupancy/Toll Road Project. This project constituted the first fully automated toll road in the United States, and was authorized through a franchise agreement with the California Department of Transportation. Nossaman was involved in the negotiation and drafting of the design-build contract. We currently represent the Orange County Transportation Authority that acquired the Express Lanes Toll Road in early 2003.
Texas Department of Transportation – North Tarrant Express Managed Lanes Project – Nossaman serves as key outside legal advisor on the procurement of a $4.7 billion public-private partnership to design, build, finance and operate managed lanes and upgrade existing facilities along a 36-mile corridor in Dallas and Tarrant counties. Infrastructure Journal named the project its 2009 Global Transport Deal of the Year.
