Tim Aspinwall focuses his practice on health law and administrative litigation, including administrative hearings, writs and appeals.

Mr. Aspinwall represents licensed professionals and institutions in their defense against administrative actions brought by state agencies and licensing boards. His individual clients include physicians, nurses, dentists, pharmacists, psychologists, midwives, social workers, chiropractors, and all other healthcare professionals. Mr. Aspinwall also represents individuals and institutional clients in medical staff peer review, and Medi-Cal and Medicare audits.

Mr. Aspinwall also represents licensed professionals before the Department of Real Estate, Board of Accountancy, State Contractors License Board, Department of Insurance, Board of Professional Engineers and Land Surveyors, and most other professionals licensed and regulated by the state.

Mr. Aspinwall is committed to public service.  In 2010-2013 Mr. Aspinwall served as chair of the American Bar Association Health and Human Service Committee of the Administrative Law section.  In 2007 – 2010, Mr. Aspinwall served on the California State Bar Lawyers Assistance Program. In 2000 – 2007, Mr. Aspinwall served as a member of the Sutter Health Central Area Institutional Review Committee.

In addition to his service to clients and the community, Mr. Aspinwall has written extensively in the areas of administrative law, professional licensing, health law, and medical ethics.  Most recently, he is a co-author of the Rutter Guide on California Administrative Law, Adjudication and Separation of Powers, with forthcoming volumes on Judicial Review and Rulemaking.  He has also published many articles in professional publications, including:

Representative Work

  • Represents licensed healthcare professionals in their defense against accusations brought by the licensing boards, including the California Medical Board, Board of Pharmacy, Board of Registered Nursing, Dental Board, Board of Chiropractic Examiners, Board of Psychology, Board of Behavioral Sciences, Physical Therapy Board, and others.
  • Represents licensed professionals, including Realtors, CPAs, licensed contractors, engineers, and most others in defense of actions brought by state agencies and licensing boards.
  • Represents medical staffs and physicians in medical staff peer review and disciplinary matters, including settlement negotiations and litigation as necessary.
  • Represents individual and institutional healthcare providers in Medicare and Medi-Cal reimbursement audits and investigations initiated by the California Department of Health Care Services Audits and Investigations, and the U.S. Department of Health and Human Services Office of Inspector General (OIG), and the Centers for Medicare and Medicaid Services (CMS).
