Adam Horsley works on transactional matters as part of Nossaman's Infrastructure Practice Group. He has assisted in developing procurement documents, drafting contract documents and researching revenue and funding sources, including state and federal grants.

Prior to attending law school, Mr. Horsley worked as a transportation analyst assisting clients in developing long range transportation plans and forecasting budget requirements.

Representative Work

Federal Highway Administration – Policy Analysis. Assisted in preparing a comprehensive analysis of strategies public agencies have used to address risks associated with public-private partnership procurements. This analysis involved a review of current knowledge and practices regarding risk management in project development, including a survey of state and federal statutes, regulations, and guidance on procurement policies, and review of provisions included in past agreements.

Georgia Department of Transportation – Rest Area Privatization/Commercial Activities in Federal-Aid Highway Rights of Way. Analyzed and federal restrictions on advertising and other commercial activities at rest areas and requirements applicable to contracts for private operation of rest areas and information centers. Prepared research memo describing requirements related to utility accommodation and airspace leases for new facilities within federal-aid highway rights of way.

Georgia Department of Transportation – Northwest Corridor Project. Assisted in drafting procurement documents for the Northwest Corridor Project, a concession to design, construct, finance, operate and maintain a 29-mile segment of managed lanes along I-75 and I-575.

Port Authority of New York and New Jersey – Toll Enforcement Strategy and Model Legislation. Developed white papers summarizing current state practices related to toll enforcement and describing various statutory schemes states have employed to enhance collections and facilitate cooperation among toll authorities. Drafted model legislation for a new toll enforcement program emphasizing interstate cooperation and increased penalties for chronic violators. Analyzed federal incentive and enforcement programs and proposed a model for a new federally funded program to support out-of-state toll collection.

Metropolitan Washington Airports Authority – Public Involvement Requirements for Toll Rate Increases. Researched federal public hearing requirements to determine whether any law or regulation would limit MWAA's ability to conduct "open forum" hearings as part of its toll rate setting process.

California/Oregon/Washington – Alternative Fuels Corridor. Prepared SEP-15 application and supplementary materials seeking experimental authority to allow commercial activity in state-owned right of way. Assisted in developing strategy for a coordinated tri-state effort to allow operation of alternative fuel stations along the I-5 corridor.

Marin County Transportation Authority – Safety Program Signage. Reviewed "Smart Steps," a local safety improvement program, which involved erecting large signs and banners in and adjacent to highway rights of way, to determine whether those displays violated requirements related to the control of signage imposed by the federal and California Manuals on Uniform Traffic Control Devices.

Virginia Department of Rail and Public Transportation – Dulles Corridor Metrorail Project. Assisted in representing the Virginia Department of Rail and Public Transportation in contract negotiations for the design and construction of the Dulles Corridor Metrorail Project, which includes the extension of the Metrorail along the 23-mile Dulles Corridor between the existing Metrorail Orange Line near the West Falls Church station in Fairfax County, Virginia, to Route 772 in Loudoun County, Virginia. The total project value was approximately $3 billion. Responsibilities included drafting contract documents, attending negotiation sessions, and evaluating and providing recommendations regarding project risks.

Virginia Department of Transportation – Dulles Toll Road Transfer. Assisted in drafting series of agreements documenting the Virginia Department of Transportation's transfer to the Metropolitan Washington Airports Authority of the right to operate, maintain and collect tolls on the Dulles Toll Road in exchange for the Airports Authority's obligation to finance, design and construct the extension of Metrorail to Dulles Airport.
