Nossaman Partner and Land Use Practice Group Leader, Paul Weiland, is quoted in California Real Estate Journal's article, "Species Protected, but with Misgivings." The article discusses the May 14th decision to list the polar bear as a threatened species and the potential implications to builders whose projects may be fought on the basis of their possible impact on climate change.
Mr. Weiland is quoted as saying, "It should be expected that while this Administration is attempting to limit the extent to which the polar bear listing is a sword that can be used by parties that oppose projects that have greenhouse gas emissions, that issue will eventually find its way into court and be decided by the judiciary."
