Nossaman attorneys participated in the 2017 Design-Build in Transportation Conference held in Minneapolis from March 27-29, 2017.  The host of this event, the Design-Build Institute of American (DBIA), is an organization that defines, teaches, and promotes best practices in design-build project delivery and is uniquely positioned to help professionals respond to this movement to improve America's roads, bridges, and aviation facilities.  

On March 28 at 9:30 a.m., Evan Caplicki presented on "Warranties: Ensuring Performance After Project Completion."  His session covered federal rules regarding warranties, attributes of an effective and appropriate warranty program, comparisons of warranty provisions on different projects, and the administration and performance of warranty programs.  

At 10:45 a.m., Yukiko Kojima participated on the panel, "Transit P3s - Issues and Lessons Learned."  Her session covered issues of particular relevance to the procurement of, and risk allocations for, transit P3s, and a sharing of lessons learned by owner representatives on transit P3 projects at various stages of procurement and completion across North America.  

At 3:15 p.m., Nancy Smith spoke on the panel addressing, "Owner and Design-Builder Responsibility and Liability for Design and Construction Defects."  This session discussed case law, statutes, and contract provisions limiting the design-builder's liability, as well as steps that the parties may wish to consider to manage the risk of defects and reduce liability.
