California Rule and Public Retirement System Governance

Ashley Dunning and Peter Mixon discuss the highly anticipated California Supreme Court ruling on the scope of the “California Rule” in their recent Daily Journal article, “California Rule and Public Retirement System Governance."

In the article, Ashley and Peter explain the Court’s March 2019 decision in Cal Fire Local 2881 v. California Public Employees’ Retirement System and discuss the next case in line for Court review that considers the California Rule: Alameda County Deputy Sheriff’s Assn. v. Alameda County Employees’ Retirement Assn., et al., California Supreme Court Case No. S2470 (review granted March 28, 2018) (“Alameda”).  They also explore some potential ramifications to public retirement systems’ efforts to correct system errors and to improve retirement system administration that may result from the Court’s decision in Alameda.   Just two days after the Daily Journal article was published, the Supreme Court informed counsel of record that Alameda is likely to be set for oral argument “in the next few months.”  Stay tuned.
