Negotiating a Favorable Settlement for a Property Easement Acquisition

We represented a family that owned a 50+ acre property along the coast in Morro Bay. The City of Morro Bay sought to acquire a portion of the property for a wastewater treatment facility. Such a development would impact the value of the remaining property. Our Eminent Domain & Valuation Group successfully negotiated a favorable settlement for our client that addressed fair compensation and ensured appropriate development rights moving forward.

A project valued at more than $125 million, the City of Morro Bay Water Reclamation Facility Program represents the largest infrastructure project in Morro Bay history, and will replace the City’s existing wastewater treatment plant with an advanced water purification facility. Our team negotiated with the City over a period of several months to insure that our clients received the most equitable agreement for use and subsequent purchase of easements on their property.  Our knowledge of the nuances of property valuation and condemnation were extremely helpful in enabling us to achieve a successful and efficient solution for our clients, and avoid costly and extended litigation. The matter came to a satisfying conclusion with the recent closing of the property acquisition, enabling our clients to move forward with their future plans for the property, and the City to remain on track with the development of an essential public project.
