Right of Way 101 – An Overview of the Condemnation Process
Brad Kuhn and Jillian Friess Leivas presented “Right of Way 101 – An Overview of the Condemnation Process” during the International Right of Way Association (IRWA) Chapter 11 Luncheon on April 18, 2023.
Right of way and condemnation is the overarching process that encompasses everything from identifying project alternatives to ultimately acquiring specific property. Brad and Jillian provided an overview of the entire process and illustrated how all of the individual components work together. In particular, they provided insight into how to effectively navigate the precondemnation process to position for the possibility of condemnation and provided insight into precondemnation best practices to avoid pitfalls in future condemnation litigation.
