David Lee Highlighted for Representation of Sacramento County Employees' Retirement System

David Lee was featured in the Daily Journal article “Sacramento Pension System Sues Software Provider.” The article provides an overview of how Nossaman's client—the Sacramento County Employees' Retirement System (SCERS)—recently sued a management software provider for $18 million claiming breach of contract. The lawsuit results from the County signing a contract in 2017 with a company—known then as Morneau Shepell—for a new platform to manage its pension data. The company was subsequently acquired by the defendant in the case, Telus Health Ltd., which is based in Canada.

The article quotes directly from David’s complaint in the matter where he wrote, “Pursuant to the initial 2017 Agreement, Defendant was required to deliver and implement the Ariel System by June 1, 2021 … Given the highly-complex implementation required for the System, SCERS participated in numerous meetings with Defendant. Throughout those meetings, Defendant represented to SCERS that it had substantial experience developing and implementing the Ariel system, and that it had specifically and successfully implemented the 'commercially available' System on prior occasions.”
