Liz Klebaner Comments on CEQA Ruling in UC Housing Fight

Liz Klebaner was quoted in the Law360 article "Noise Ruling In UC Berkeley CEQA Suit Sparks Concerns." The article examines a state appellate panel ruling that UC Berkeley's failure to “consider noise from student parties in its environmental impact review “ for proposed student housing conflated California environmental quality laws with the private interests of property owners.

Commenting for the article, Liz said the decision is "problematic…By taking nuisance ordinances and expanding CEQA's scope to protect from [prospective nuisances], it's blurred the lines."

She closed by saying, "This was not the only novel interpretation of CEQA that [I think] goes beyond the statute…[another example] are [housing] projects that have been required to include renewable energy components."
