Overview
Kyle Howe represents public entities in water, transportation and social infrastructure development. He assists clients in alternative delivery, from design-build to public-private partnerships (P3) structures and provides guidance regarding regulatory compliance, pre-qualification, requests for proposals, selection, contracting and contract administration. Kyle also supports public entities as general counsel and has a breadth of experience that informs his infrastructure practice, including handling services contracts, the purchase and sale of real estate, corporate governance and transactions and various environmental issues. With his background in water rights litigation and natural resources transactions, he brings a pragmatic perspective to the complexities of project development.
Kyle was a Sturm Law Scholar at the University of Denver Sturm College of Law and the Editor-in-Chief of the University of Denver Water Law Review. While in law school, he externed with the Hon. David Furman of the Colorado Court of Appeals and the Natural Resources and Environment Section of the Colorado Attorney General’s Office. Before law school, Kyle served in the U.S. Air Force and specialized in logistics and transportation.

Experience
Equestrian Events Center + Hotel Project, Denver, Colorado. Member of the legal team advising the City and County of Denver on the procurement of an approximately $500 million project to develop a new 6,000 seat equestrian center, on-campus hotel and associated parking for the National Western Center Campus. The project is being progressed under a predevelopment agreement that will see the private developer design, finance, construct, operate and maintain elements of the project.
Water Infrastructure Finance Authority of Arizona. Member of the legal team advising the Water Infrastructure Finance Authority in the procurement of water supply development projects supported by the Long-Term Water Augmentation Fund, a forward-thinking $1 billion investment in water augmentation for the State of Arizona.
Front Range Passenger Rail District, Denver, Colorado. Represents the Front Range Passenger Rail District as general counsel supporting the District’s efforts, in collaboration with the Colorado Department of Transportation, to develop Colorado’s first intercity passenger rail service, initially running between Pueblo and Fort Collins. The project has been accepted into FRA’s Corridor ID Program and expected to complete the service development plan in 2025.
Anderson Dam Seismic Retrofit Project, Santa Clara County, California. Member of the legal team advising Valley Water in the earthquake retrofitting of Anderson Dam to improve reliability and safety and return the reservoir to its original storage capacity. Anderson Reservoir was lowered to 3% of its capacity because seismic stability evaluations indicated that a very large magnitude earthquake may result in an adverse impact on the outlet pipe and intake structure.
Real Estate Development. Represented investors and developers in various multifamily real estate developments including due diligence, drafting transactional documents and related corporate work.
Corporate and Finance. Represented corporate clients in restructurings, asset sale-leaseback transactions and debt issuances.
Water Resources. Represented multiple public utilities in various complex water court applications, opposition to water rights applications that may injure clients' water rights and as general counsel regarding water rights and regulatory issues.
