David Farkas and David Lee were highlighted for their work on behalf of Asiana Airlines in the Law360 story “Asiana Airlines Says $50M Catering Award Can't Be Enforced” (subscription required).
The piece provides an overview of Asiana's request that a California federal court refrain from enforcing a $50 million foreign arbitral award in favor of a catering company – Gate Gourmet Korea Co. Ltd – that would guarantee the caterer “unheard of profits.”
Asiana stated that the disputed contract with the catering company was part of a larger plan to enrich the former CEO of Asiana Airlines, Park Sam-koo, and was only executed after a bribe was directed to him. Mr. Sam-koo was jailed for embezzlement in 2022. The airline told the court that the award cannot be enforced because it is the result of criminal activity.
