Simon Adams Discusses Challenges Facing Latest CDC Eviction Ban

Simon Adams was quoted in the Law360 article, “CDC's New Eviction Freeze Poised For Major Legal Hurdles” (subscription required). The article examines the latest moratorium on residential evictions from the Centers for Disease Control and Prevention (CDC), which will cover roughly 90% of the U.S. population, and the legal challenges that likely await.

The article notes that this CDC ban comes just over a month after the Supreme Court denied a request to lift a prior CDC moratorium. At the time, Justice Kavanaugh said "clear and specific congressional authorization (via new legislation)" was required to extend the ban beyond the end of July.

Commenting on what may come next, Simon Adams remarked, "I would anticipate that any CDC action will also be found to be contrary to the law. That decision will need a plaintiff that wants to challenge this and a court decision will be delayed due to the speed of the courts."
