Svend Brandt-Erichsen Discusses Significant Environmental and Energy Court Decisions

Svend Brandt-Erichsen was interviewed by Law360 for its article “The Biggest Energy & Environmental Court Decisions of 2025.” (subscription required)

Svend discussed the Seven County Infrastructure Coalition et al. v. Eagle County et al. decision, which was heard in the Supreme Court of the United States. The decision limited the scope of NEPA reviews of infrastructure projects and directed lower courts to defer more often to federal agencies’ reviews. Law360 noted, “Circuit courts across the country have cited the decision in backing federal approvals of pipeline and logging projects.”

Svend said the ruling, which came down on May 29, 2025, “has been the most significant NEPA ruling in many years, if not in the last decade.” He added , “We haven't seen an impact on agency NEPA practice yet, but I think we will.”
