Overview
Andrew Kim represents employers in labor and employment litigation, with a focus on wage-and-hour defense. His clients range from small businesses to multinational corporations facing class actions and PAGA representative actions, along with individual claims involving meal and rest periods, overtime, off-the-clock work and wage statement violations under the California Labor Code. Andrew has defended matters in state and federal court and in arbitration, handling cases through every phase from pleadings and discovery to mediation and resolution.
Andrew also handles wrongful termination, discrimination and harassment claims under the Fair Employment and Housing Act and general commercial litigation. A significant portion of his practice involves enforcing arbitration agreements, from drafting and briefing motions to compel through defending against challenges to arbitrability. Drawing on his Alternative Dispute Resolution Certificate from USC Gould School of Law, Andrew takes a strategic approach to resolution, working to position matters for favorable outcomes through arbitration, mediation and negotiated settlement.
On the advisory side, Andrew counsels employers on wage-and-hour compliance, arbitration agreement design, pay practices and workplace policies under California and federal law. He also advises on internal investigations, separation agreements, and day-to-day personnel issues, helping employers address exposure before it becomes litigation.
Beyond the Law
Born in Seoul and raised in Southern California, Andrew is passionate about supporting the Korean American business community and has counseled Korean companies and Korean-owned businesses on a range of employment and commercial matters as they navigate the California legal landscape. He views that work as both a professional focus and a way of giving back to the community that shaped him. A lifelong Lakers and Dodgers fan going back to the days when Eddie Jones was starting over Kobe and Mark Grudzielanek was holding down shortstop, Andrew brings that same long-game patience to the golf course. He carries a 9.4 GHIN despite what he freely admits is a horrendous wedge game. Outside of work, Andrew and his wife spend their free time exploring parks around Southern California with Tori, their Mini Goldendoodle.
