Overview

Joshua Deal represents owners, developers, general contractors, subcontractors and suppliers in litigation and transactional matters relating to construction law issues. Josh litigates matters in state and federal courts in New York and New Jersey and has extensive experience handling appeals. He represents construction industry clients on contract disputes, construction defect claims, delay claims, payment and performance bond claims, mechanic’s lien claims and adjacent property damage claims. In addition, Josh drafts and negotiates construction agreements and license and access agreements, and counsels clients on project management, risk management, insurance and dispute resolution issues at all stages of projects.

Experience

Experience

Led the team in the New York County Commercial Division litigation for a rebar supplier and installer on a New York public project for breach of contract and claims under its payment bond. Successfully obtained summary judgment in the full amount of the client’s $1.4 million claim.

Advised a lender taking over a distressed $35 million construction project to rehabilitate a resort complex in South Florida, including negotiating the construction contracts for the takeover. Successfully negotiated the owner’s contracts with the general contractor and specialty trade contractors and resolved lien law issues.

First Chair in AAA construction dispute representing the owner in claims against the contractor for breach of contract, delay and defective work. Resulting in a favorable settlement after the first day of the hearing.

Second Chair in AAA construction dispute representing the owner of a property that was damaged by adjacent construction. Resulting in a favorable settlement after the third day of the hearing.
