Ashley Dunning and Yuliya Oryol spoke during the National Association of Public Pension Attorneys’ (NAPPA) 2023 Winter Seminar, a three-day session which occurred February 22 - 24, 2023 in Tucson, AZ.

On February 22, 2023, Yuliya moderated a panel on the topic “The Evolving Role of Consultants.” This panel discussed the evolving role of investment consultants used by investors to help them select managers and recommend appropriate levels of allocation to different financial products and investment vehicles. The panel addressed the different types of consultants and the role of board members, investment staff, administrators, in-house counsel and outside counsel in working with consultants to conduct diligence, negotiate terms and monitor performance.

Later that afternoon, Ashley served as a panelist on the topic “Internal Investigations, Board Privilege, and Outside Counsel, Oh My!”. This session covered best practices for handling investigations within retirement systems, the nuances of the attorney client privilege and fiduciary obligations between trustees, system personnel and board counsel in such situations and what circumstances may require outside counsel. The discussion touched on the impacts of these considerations on both in-house counsel and external counsel to a system.

NAPPA is a professional and educational organization created in 1987. Its membership consists exclusively of attorneys that represent public pension funds. Their purpose is to provide educational opportunities and informational resources for its member attorneys.
