On March 1, 2021, Brooke Marcus Wahlberg and Rebecca Hays Barho presented “Navigating Wildlife and Natural Resource in the Sooner State” for the Environmental Federation of Oklahoma (EFO).   • An overview and update on the litigation challenging the 2019 Endangered Species Act (ESA) amendments, including the “habitat” definition and Section 4(b)(2)
  • Developments related to the status of the monarch butterfly, American burying beetle, interior least tern, bat and other species in Oklahoma
  • An overview and update on the new Nationwide Permits (NWPs) and litigation involving NWP 12
  • An overview and update on the litigation challenging the National Environmental Policy Act (NEPA) regulatory amendments
  • An overview and update on the status of the Migratory Bird Treaty Act (MBTA) and related regulatory actions and litigation
  • A recap on other recent litigation affecting administration of ESA, NWPs and the National Historic Preservation Act (NHPA), including challenges to R Project and major pipelines
  • Recent and anticipated Biden Administration actions related to the above
