On March 1, 2021, Brooke Marcus Wahlberg and Rebecca Hays Barho presented “Navigating Wildlife and Natural Resource in the Sooner State” for the Environmental Federation of Oklahoma (EFO). They discussed the potential impact that recent natural resource regulatory actions and related litigation may have on private corporations and public agencies operating in Oklahoma.   • An overview and update on the litigation challenging the 2019 Endangered Species Act (ESA) amendments, including the “habitat” definition and Section 4(b)(2)
  • Developments related to the status of the monarch butterfly, American burying beetle, interior least tern, bat and other species in Oklahoma
  • An overview and update on the new Nationwide Permits (NWPs) and litigation involving NWP 12
  • An overview and update on the litigation challenging the National Environmental Policy Act (NEPA) regulatory amendments
  • An overview and update on the status of the Migratory Bird Treaty Act (MBTA) and related regulatory actions and litigation
