NLRB Regional Offices Won 87% of Unfair Labor Practice Cases in 2011

On March 8, 2012, summarizing the National Labor Relations Board’s activities in 2011, the Acting General Counsel issued a report stating that NLRB regional offices won 87 percent of unfair labor practices cases litigated before the board and administrative law judges in whole or in part in fiscal year 2011.  The report noted that (1) the win rate has ranged between 78 percent and 91 percent over the past 10 years, (2) the agency was successful in steering those unfair labor practice cases it deemed to be meritorious toward settlement in 2011 with 6,246 settlements of unfair labor practice cases, representing a rate of 93 percent of cases found to have merit, (3) the percentage of unfair labor practices cases for which formal proceedings were found to be warranted slightly rose to 37 percent compared to 35.6 percent of cases in 2010, and (4) the amount of recovery for employees were smaller in 2011 than 2010 for employees.
