Fred Kessler Quoted on Pennsylvania Turnpike Litigation

Fred Kessler, a Partner in Nossaman’s Infrastructure Group, was quoted in the Philadelphia Magazine story, Why Fate of SEPTA’s Big Plans Depend on Outcome of PA. Turnpike Lawsuit. The story examines a lawsuit against the Pennsylvania Turnpike Commission challenging on Commerce Clause grounds the use of tolls from the Pennsylvania Turnpike for SEPTA’s transit systems in the Philadelphia region.  

The challenge, if successful, will lead to severe cuts for SEPTA and may impact its plans to update its transit systems. Commenting on a federal law that helped the NY State Turnpike Commission triumph in a similar lawsuit, Fred said that he could make a strong argument that the federal law shows that Congress has allowed extra toll revenue to be used for other transportation projects.
