Overview

Jennifer Seely is an environmental attorney whose practice spans permitting, compliance, administrative adjudications and litigation. She represents clients on issues related to air quality, water, environmental health and spill prevention and response. Jennifer has a wealth of knowledge in federal and Alaska environmental law, particularly the Clean Air Act and Clean Water Act. Her experience includes negotiating Alaska’s state air quality plan, developing Alaska’s nuclear facility siting regulations and helping to create Alaska’s hazardous waste regulatory program. She has defended and enforced permits for water discharges and air emissions, as well as contaminated site cost recovery and negotiations.

Prior to joining Nossaman, Jennifer served as an Assistant Attorney General with the Alaska Department of Law where she advised and represented the Alaska Department of Environmental Conservation.

Experience

Experience

Fairbanks North Star Borough PM2.5 Serious SIP. Counsel for State of Alaska in negotiations and coordination with the U.S. Environmental Protection Agency on the state air quality plan for the greater Fairbanks area, including developing new regulations.

Clean Water Act Enforcement Lawsuit. Counsel for State of Alaska in joint federal-state lawsuit in U.S. District Court of Alaska against a construction company, alleging violations of Clean Water Act sections 402 and 404 at three sites in Juneau, Alaska.

Natural Resource Damage Assessments. Trustee for State of Alaska in natural resource damages cases concerning the MV Selendang Ayu and the MV Western Mariner, coordinating with state and federal agencies including the U.S. Fish & Wildlife Service and the National Oceanic and Atmospheric Administration.

Administrative Adjudications for Water Permits. Counsel for State of Alaska water permit staff, defending permit actions and compiling administrative records in adjudications before Alaska’s Office of Administrative Hearings.

Resource Conservation and Recovery Act (RCRA) Program Development. Counsel for State of Alaska in developing materials to apply for program authorization from the U.S. Environmental Protection Agency for the state to run the RCRA Subtitle C hazardous waste program.

Alaska Nuclear Facility Siting. Counsel for State of Alaska in updating state nuclear statutes and creating state nuclear facility siting regulations in relation to the U.S. Air Force’s choice of Eielson Air Force Base for a microreactor.

Alaska Contaminated Sites. Counsel for State of Alaska on a variety of contaminated sites to recover state costs, demand and obtain work plans, and negotiate prospective purchaser agreements and environmental covenants.
