Overview

Kasia Penn represents clients in insurance recovery, complex litigation and breach of contract disputes. She also is experienced in handling matters involving product liability, general liability, construction defect and toxic tort. Her practice includes all stages of litigation, including pre-lawsuit negotiations and trial work. Kasia is a graduate of Trial Advocacy Project (TAP), which allowed her to act as a voluntary deputy city attorney with the City of Los Angeles.

  • Santa Clarita Valley Water Agency v. Whittaker. Member of the legal team representing the Santa Clarita Valley Water Agency in an appeal after jury verdict in favor of the Agency and judgment of $69 million for clean-up of perchlorate and VOC contamination in the Upper Santa Clara River basin. In addition to claims of negligence, public nuisance and private nuisance arising out of the subsurface intrusion of contaminants into the Agency’s drinking-water wells, the Court also awarded investigation costs under CERCLA.
  • Sunfarms, LLC v. Eurus Energy America Corporation. Member of the appellate team following the successful defense of Eurus Energy America Corporation in a multi-claim contract dispute connected to the development of two renewable energy projects in Hawai’i .
  • Dominguez Channel litigation. Member of the litigation team for the County of Los Angeles relating to claims of dangerous conditions and inverse condemnation.
  • Hurd & George, Inc. v. Los Angeles Department of Water and Power. Member of the litigation team representing the Los Angeles Department of Water and Power relating to lease issues.
