“WOTS” is Where It’s At!

California Building Industry Association’s 60th Select Conference on Industry Litigation

On November 12th, Mary Lynn Coffee presented “‘WOTS’ Is Where It’s At!,” a 2023 update regarding state and federal wetlands protection regulations and litigation, during the California Building Industry Association’s 60th Select Conference on Industry Litigation.

During this presentation, Mary Lynn discussed the following topics:

  • New Federal Clean Water Act regulation of jurisdictional Waters of the United States (WOTUS);
  • New Federal Clean Water Act regulations governing State 401 Certifications for federal discharge permits;
  • California State regulation of discharges of dredge and fill material to Waters of the State (WOTUS) – 401 Certifications and Waste Discharge Requirements (WDRS).

The California Building Industry Association (CBIA) is a statewide trade association based in Sacramento representing thousands of member companies including homebuilders, trade contractors, architects, engineers, designers, suppliers and industry professionals in the homebuilding, multi-family and mixed-use development markets. CBIA hosts the Select Conference on Industry Litigation (SCIL) twice a year. SCIL is an event where the homebuilding and development industry’s top attorneys gather to discuss a wide range of topics facing our industry. Topics often include CEQA, land use, environmental permitting, prevailing wage, and other issues.
