Overview

Maya Hamouie focuses on construction claims and complex infrastructure disputes for public agencies and private owners across the United States. Her practice centers on high-stakes public works matters involving delay and disruption claims, change order disputes, liquidated damages, contract interpretation, entitlement disputes and claims avoidance and defense preservation, while maintaining a strong foundation as a trial and arbitration advocate. She represents clients throughout the full lifecycle of construction disputes, from pre-claim counseling, contract administration and claims administration through mediation, arbitration and trial.

Maya's work often involves multi-party disputes and expert-driven issues arising from large-scale infrastructure projects, including bridges, highways, transportation corridors and water and utility facilities. She also advises public agencies in connection with bid protests and public procurement disputes, including challenges to bid responsiveness, responsibility determinations and award decisions. Her litigation experience includes drafting and arguing dispositive motions, managing extensive written discovery and document productions, developing and coordinating expert testimony, taking and defending fact and expert depositions and preparing matters for trial and arbitration hearings.

In addition to her litigation practice, Maya maintains an active pro bono practice and regularly contributes to firm leadership and professional development initiatives. She has successfully litigated a quiet title action on a pro bono basis and currently represents a minor seeking asylum. Maya is also active in professional organizations, including the Association of Business Trial Lawyers.

Experience

Los Angeles County Sanitation Districts. Representing the District in a major construction dispute arising from completion of the Valencia Water Reclamation Plant Advanced Water Treatment Facility. The matter involves contractor performance issues, delay and disruption claims, liquidated damages, and related stop notice litigation associated with project completion.

Texas Department of Transportation - U.S. 181 Harbor Bridge Replacement (Corpus Christi). Member of the legal team advising TxDOT on disputes arising from the replacement of the Harbor Bridge spanning the Corpus Christi Ship Channel, a large-scale design-build infrastructure project. Work includes contract administration support and dispute counseling in connection with an arbitration proceeding.

Texas Department of Transportation - Grand Parkway (SH 99), Segments H, I-1, and I-2. Part of the team advising TxDOT on contractor claims associated with a $1 billion, 52-mile segment of the Grand Parkway project. Assisted with claims management and contract administration in connection with a Dispute Review Board process that resulted in a defense determination in TxDOT’s favor.

Texas Department of Transportation – I-35 NEX Central Project. Member of the legal team advising TxDOT on contractor claims arising from alleged force majeure and COVID-related impacts on the I-35 NEX Central Project, including escalation claims and associated disputes concerning schedule impacts, entitlement, and contractual defenses.

Riverside County Transportation Corridor Agencies. Represented the agency in connection with a bid protest challenging a public procurement, including evaluation of bid responsiveness and defense of the agency’s award decision.

Indiana Department of Transportation.  Member of the legal team representing INDOT in a dispute arising from the rehabilitation of the Sherman Minton Bridge, including contractor claims following a structural event and emergency bridge closure. Assisted with development of contractual defenses, liquidated damages enforcement, and dispute resolution strategy in connection with mediation.

City of Modesto. Second chair in an arbitration that involved construction claims on a public roadway improvement project, including disputes over nonconforming work, contract compliance, notice requirements, and entitlement to additional compensation.

California High-Speed Rail Authority – Construction Package 4. Member of the legal team advising the CP 4 project team on contract administration and construction claim issues for a major segment of the California High-Speed Rail project, including disputes involving utility relocations and delay and disruption claims.

City of San Diego – Pure Water Program. Member of the legal team providing construction claims and contract administration support to the City in connection with the Pure Water Program, a large-scale, multi-contract water infrastructure initiative.
